It is a tribunal that would determine this based on the evidence available and an assessment on the strength of the discrimination. The lower band is for &quot;less serious cases&quot; where the act of discrimination is a one-off or isolated occurrence. Depending on the findings and severity, the next &quot;middle&quot; band may be deemed appropriate. Higher bands are unusual. The bandings are broad on purpose to give the Tribunal flexibility to decide what is an appropriate award based on the evidence presented.]]></description>
